Carbis Bay Holidays is a trading name of Printcater Limited. The company is registered in England with Registered Number: 02779888 and the Registered Address is White House, Wollaton Street, Nottingham, NG1 5GF. Customers renting the property through Carbis Bay Holidays are referred to as the “Guests” or the “Guest”. Carbis Bay Holidays act as “Agents” for the owners of the property (hereafter referred to as the “Owners” or the “Owner”). The rental arrangements are made by the Agents, on behalf of the Owners and the contractual relationship is directly between the Owner and the Guest. The agents will, on request and with approval from the owners, provide the names and address details of the owners of the property in which they have made a reservation.
Arrival & Departure Times:
Rentals are for a maximum of four weeks and commence at 3.00pm on the first day of the rental and end at 10.00am on the day of departure unless otherwise notified. This period is hereafter referred to as the “Holiday”
The period booked will be stated on the reservation confirmation provided to the Guest when they book and cannot be exceeded unless Carbis Bay Holidays give written approval. The Guest will be liable for any cost, of whatever nature, incurred because of an unauthorised extension.
When a reservation is made via the reservation form on the Carbis Bay Holidays website (the “Website”), the Guest has 5 days from the day they receive the reservation confirmation, in which to make a payment to secure the Holiday. Last Minute holidays which commence in the next 7 days have 24 hours from the time of reserving. This then becomes a “Booking”.
If a Booking is made six weeks or more before the Holiday is due to start, a deposit of one-third of the rent is payable. If a Booking is made less than six weeks before the start of the Holiday, the full rent plus any additional charges must be paid at the time of booking. Should the Agents not accept or reject a booking request, the rent and any additional charges paid by the Guest will be refunded immediately.
Unless otherwise agreed by the Agent in writing, the price for the Holiday shall be the rent for the property as set out on the Website at the time of the booking.
Subject to a cancellation, as soon as the booking is confirmed by the Agents, the Guest is liable for payment of the balance of the rent.The rent is payable to Carbis Bay Holidays six weeks before the start of the Holiday (the “Due Date”) and non-payment by the Due Date may be treated as a cancellation. If payment is not received by the Due Date, then the Guest will lose their booking and the deposit will be forfeit. The Due Date will be set out on your Reservation Confirmation.
Method of Payment:
Payments may be made by debit or credit card, cheque or electronic bank transfer. Cheques should be made payable to “Carbis Bay Holidays Client Account”. Post-dated cheques are not acceptable. Debit card transactions are free of charge and all payments made by credit card will be subject to a non-refundable 2% surcharge. Any charges raised against the Agents by their bank for handling dishonoured cheques or any other payments will be passed on to the Guest, by way of a deduction from the security deposit.
A non-refundable booking fee of £22.50 is payable on all bookings.
Overseas Guests may pay in Sterling by cheque drawn on a UK bank, or by international electronic transfer. Our SWIFT and IBAN numbers will be provided on request. Any charges for payments from overseas will be passed on to the Guest via a deduction from the security deposit.
All prices quoted include VAT i.e. Owners of properties shown on the Carbis Bay Holidays Website are not registered for VAT, in which case no tax is payable. Where VAT is payable, the tax is included in the weekly rent which is subject to change by Government Legislation.
A security deposit is due for payment with the Final Payment towards the Holiday. In most instances, this is £100.00, however, a larger deposit may be required, depending on the property selected. The whole amount of the Security Deposit, or the balance after any deduction will be refunded to you within 14 days following the end of the Holiday. The Owner shall be entitled to deduct from the Security Deposit the cost of remedying any breach of Guest’s Obligations. Please note that damages and losses are not limited to the security deposit and any costs in excess of this amount will be invoiced and payable in full without delay.
Return of Security Deposit:
The security deposit will be returned within 2 weeks of the end of the holiday. In most cases by the same method your balance payment was made by. No charges are made for returning the deposit to a credit card. In certain circumstances it may not be possible for us to pay you back by credit / debit card. In these instances the security deposit will be refunded by cheque made payable and posted to the addressee on the booking.
Condition of Property:
Please ensure that you follow the instructions in the welcome manual of the property on your departure. A House Keeper report is provided to Carbis Bay Holidays when you have left and any losses, damage or any cleaning necessary over and above normal servicing, will be deducted from your security deposit. By sending the reservation form, you authorise us to deduct payment for these from your security deposit.
Bed linen is changed between Holidays and a change of linen is provided weekly during Holidays. There is no additional cost for linen or the weekly linen change service. All beds will be made up on arrival. A set of towels (not including beach towels) is included in all properties.
Most of our properties have a parking space for at least one car. For apartments specifically at the Carbis Beach development, a charge will apply of £7.00 per day or £45.00 for the week for an additional space (where available).
Changing a Booking:
Once the dates of a booking have been accepted by the Agent, the booking can only be changed to another property by treating the original booking as a cancellation. The dates of the Holiday may be changed at our discretion, providing the same property is available for the new dates, Carbis Bay Holidays reserve the right to charge the same price for the new dates as that charged for the original booking. The Agents reserve the right to make an administration charge.
A booking can only be cancelled prior to the start of the Holiday. A Guest who wishes to cancel the Holiday must notify The Agent in writing within seven days of them becoming aware that they cannot take up the Holiday, (“Cancellation Notice”). If a Cancellation Notice is received six weeks or more before the Holiday is due to start, the balance will be cancelled. If cancellation is made less than six weeks before the start of the holiday, the balance is payable in full. There is an administration change of £50.00 for cancellations. In the event of a cancellation, The Agent will use their best endeavours to secure another booking in the same property for the same week. If this is achieved, all monies paid for this replacement booking, less the £50.00 administration charge, will be refunded. If due to any occurrence beyond the control of the owner or his agent, the accommodation is unavailable as booked e.g. fire, flood etc, all monies paid will be refunded in full but there will be no further liability towards the hirer.
We do not accept bookings from groups of single people under the age of 25 and all male or all female parties of more than three people. Individual properties may have other restrictions, please see the appropriate property page on our website.
All complaints must be notified to the Agent as soon as reasonably practicable, as the Agent may be required to carry out an on-the-spot investigation and if necessary, request the Owner to take remedial action. Should you have a complaint, please allow the Agent or the Owners the opportunity to put matters right during the Holiday.
Pets are welcome at specific properties with the prior consent of Carbis Bay Holidays and the Owners. They must be kept under control, exercised off the premises and not allowed on furniture or in the bedrooms. Under no circumstances should a pet be left unaccompanied within the property as this can result in considerable damage to the property and cause distress to the pet. There is no additional charge per pet for any length of holiday, however if additional cleaning is required then this will be deducted from Guest’s security deposit. Unless outlined on the Website property page, Pets are not permitted in any properties marketed by the Agents or Owners where we state “Regret no pets”. Unfortunately we are not able to guarantee that no pets have previously been kept in any Property.
Free Broadband / WIFI:
All properties providing an internet connection do so as a free service. No guarantee can be made that the service will be compatible with your device. No technical support for the connection is available. Due to the number of parties involved in providing the service we cannot guarantee functionality of the connection although will where possible advise guests of any known problems prior to the stay. Should the broadband connection not be functioning for any reason no liability is taken by either the owner or Carbis Bay Holidays.
We are pleased to be able to provide properties with Sky TV, please check the individual properties description for the Sky package provided. Please note that Carbis Bay Holidays are unable to provide the PIN to the Sky box. Therefore there may be viewing restrictions applied during the day as per Ofcom regulations e.g. Watershed limitations. We apologise for any inconvenience caused.
The Agents reserve the right to amend prices quoted, due to errors or omissions. While every endeavour is made to portray a true representation of the website properties, no guarantee can be given to the accuracy of the photographs or descriptions.
Any personal effects left by guests can be forwarded to their home address at a cost of £5.00 plus postage. Unclaimed articles will be disposed of after 28 days.
The Guest’s Obligations:
The Guest has the right to occupy the property for a Holiday only (within the meaning of schedule 1, Paragraph 9 of the Housing Act 1988.) The Guests agree:
(a) That in no circumstances should overnight accommodation be provided for guests other than those outlined on the Reservation Form unless Carbis Bay Holidays are notified in advance.
(b) To undertake to pay for any losses or damage to the property caused (reasonable wear and tear excepted).
(c) To take good care of the property and leave it in a clean and tidy condition at the end of the tenancy.
(d) To permit the Owners and Agents reasonable access to the property.
(e) That a cot may only be occupied by a child aged 24 months or less. Carbis Bay Holidays are not responsible for the maintenance of cots.
(f) Not to cause an annoyance or become a nuisance to occupants of adjoining premises.
(g) Not to smoke at a non-smoking property.
In the event of breach of these terms and conditions, the Guests may be required to leave the property during the period of the booking.
The Agents do not accept liability for any act, neglect or default on the part of the Owners or any other person not within their employ, nor for any accident, damage, loss, injury, expense or inconvenience whether to person or property, which the Guests or any one connected with the Holiday may incur. We reserve the right to provide alternative accommodations or cancel owing to unforeseen circumstances beyond our control. If for any reason beyond the Owners control, the property is not available on the date booked (owing to fire damage for example) or the property is unsuitable for a Holiday, all Holiday payments and additional charges paid in advance by the Guests will be refunded in full, but the Guests shall have no further claim against the Owners or Agents
The Agents are not and shall not be held responsible for any maintenance / building works taking place outside of the rental property. No Claim or Liability shall be accepted by the Agent.
All properties are used at your own risk. At properties where there is a balcony or elevated terrace, this is used at your own risk. Parents should ensure that their children are supervised in such areas at all times.
Governing Law & Jurisdiction:
The contract is deemed to have been made at 8 Marl Road, Radcliffe-on-Trent, Nottingham, NG12 2GY the validity, construction and performance of this Agreement shall be governed by English Law. The Guests submit to the exclusive jurisdiction of the English Courts.
Authority to Sign:
The person who sends the reservation form certifies that he or she is authorised to agree the Terms and Conditions on behalf of all persons included on the booking form, including those substituted or included at a later date. He or she agrees to take responsibility for the party occupying the property.
In case of a discrepancy between these Booking Conditions and any other contents of the Carbis Bay Holidays website, these Conditions shall prevail, but this shall not limit the Agents liability for failure to supply the accommodation as described on the website.
In the event that a court finds that a condition in these Booking Conditions is illegal or void, the illegal or void provision will be severed from the remainder of the Booking Conditions, which will continue to be valid and have full force and effect.
