Arrival & Departure Times: Rentals are for a maximum of four weeks and commence at 3.00pm (Unless otherwise stated in the web listing for your chosen property) on the first day of the rental and end at 10.00am on the day of departure unless otherwise notified. This period is hereafter referred to as the “Holiday” The period booked will be stated on the reservation confirmation provided to the Guest when they book and cannot be exceeded unless Carbis Bay Holidays give approval. The Guest will be liable for any cost, of whatever nature, incurred because of an unauthorised extension.
Deposit: When a reservation is made via the Carbis Bay Holidays website (the “Website”), the Guest has 3 days from the time of reserving, in which to make a payment to secure the Holiday. Last Minute holidays which commence in the next 6 weeks have 24 hours from the time of reserving. Once payment is received this then becomes a “Booking”. If a Booking is made six weeks or more before the Holiday is due to start, a deposit of one-third of the rent is payable plus booking fee. If a Booking is made less than six weeks before the start of the Holiday, the full rent plus any additional charges must be paid at the time of booking. Should the Agents not accept or reject a booking request, the rent and any additional charges paid by the Guest will be refunded immediately.
Final Payment: Unless otherwise agreed by the Agent in writing, the price for the Holiday shall be the rent for the property as set out on the Website at the time of the booking and detailed within confirmation emails / letters. Subject to a cancellation, as soon as the booking is confirmed by the Agents, the Guest is liable for payment of the balance of the rent. The rent is payable to Carbis Bay Holidays six weeks before the start of the Holiday (the “Due Date”) and non-payment by the Due Date may be treated as a cancellation. The Due Date will be set out on your Reservation Confirmation, Balance Payment reminder emails will be sent 14 days, 7 days and on the day the payment is due. If payment is not received by the Due Date, then the Guest will lose their booking and the deposit will be forfeit.
Method of Payment: Payments may be made by debit or credit card, cheque or electronic bank transfer. Cheques should be made payable to “Carbis Bay Holidays Client Account”. Post-dated cheques are not acceptable. There are no fees for paying by Debit or Credit card. Any charges raised against the Agents by their bank for currency exchange or handling dishonoured cheques or any other payments will be passed on to the Guest, by way of a deduction from the security deposit.
Booking Fee: A non-refundable booking fee of £25 is payable on all bookings at the time of Deposit Payment or Full Balance payment for ‘last minute’ bookings.
Overseas Bookings: Overseas Guests may pay in Sterling by cheque drawn from a UK bank, or by international electronic transfer. Our SWIFT and IBAN numbers will be provided on request. Any charges for payments from overseas will be passed on to the Guest via a deduction from the security deposit. To help you save money, we have teamed up with Transferwise.com who offer considerably lower currency exchange and transfer fees compared to ‘high street banks’. Details for this service are available on request.
VAT: All prices quoted include VAT where applicable i.e. Owners of properties which are shown on the Carbis Bay Holidays Website are not registered for VAT, in which case no tax is payable. Where VAT is payable, the tax is included in the weekly rent which is subject to change by Government Legislation.
Security Deposit: A security deposit is due for payment with the Final Payment towards the Holiday. In most instances, this is £100.00, however, a larger deposit may be required, depending on the property selected. The whole amount of the Security Deposit, or the balance after any deduction will be refunded to you within 14 days following the end of the Holiday. The Owner shall be entitled to deduct from the Security Deposit the cost of remedying any breach of Guest’s Obligations. Please note that damages and losses are not limited to the security deposit and any costs in excess of this amount will be invoiced and payable in full without delay.
Return of Security Deposit: The security deposit will be returned within 14 days of the end of the holiday. In most cases by the same method your last payment was made by. Should your most recent payment not cover the amount, or the payment method no longer be in use the previous payment method will be used. No charges are made for returning the deposit to a credit card. In certain circumstances it may not be possible for us to pay you back by credit / debit card. In these instances, the security deposit will be refunded by cheque made payable to and posted to the lead addressee on the booking or bank transfer.
Condition of Property: Please ensure that you follow the instructions in the welcome manual of the property on your departure. A Housekeeper report is provided to Carbis Bay Holidays when you have left and any losses, damage or any cleaning necessary over and above normal servicing, will be deducted from your security deposit. By sending the reservation form, you authorise us to deduct payment for these from your security deposit.
Linen: Bed linen is changed between Holidays and a change of linen is provided weekly during multi week Holidays. There is no additional cost for linen or the weekly linen change service. Please note that a weekly clean is not provided as part of this service. All beds will be made up on arrival. A set of towels per person (not beach towels unless indicated on the property listing) is included in all properties.
Parking: Most of our properties have at least 1 parking space provided at no cost, details for the arrangements are provided on the property listing.
Additional Parking: Some properties offer additional parking for a fee, please check the property listing for details or contact the office.
Keys: Most properties offer 2 sets of keys however we cannot guarantee the availability of more than 1 set as it isn’t uncommon for keys to be taken home by guests in error
Changing a Booking: Once the dates of a booking have been accepted by the Agent and payment made, the booking can only be changed to another property by treating the original booking as a cancellation. The dates of the Holiday may be changed at the owner’s discretion, providing the same property is available for the new dates, the owner reserves the right to charge the same price for the new dates as that charged for the original booking. Please note a Transfer Administration fee will apply.
Cancellation: A booking can only be cancelled prior to the start of the Holiday. A Guest who wishes to cancel the Holiday must notify The Agent in writing (an email is acceptable) within seven days of them becoming aware that they cannot take up the Holiday, (“Cancellation Notice”). If a Cancellation Notice is received six weeks or more before the Holiday is due to start, the balance payment will be cancelled. If cancellation is made less than six weeks before the start of the holiday, the balance is payable in full. There is an administration change of £50.00 for cancellations. In the event of a cancellation, The Agent will use their best endeavours to secure another booking in the same property for the same period. If this is achieved, the applicable monies paid for the replacement booking (s), less the Booking Fee and £50.00 Cancellation charge, will be refunded. Should the property be made unavailable for any of the period covering your cancellation, a refund will be made based on the pricing model used for your booking i.e. short break or pro rata, if made unavailable i.e Owner Booked during a discounted period the applicable discount will be made to the refund. If due to any occurrence beyond the control of the owner or his agent, the accommodation is unavailable as booked e.g. fire, flood etc, all monies paid will be refunded in full but there will be no further liability towards the hirer.
Eligibility: We do not accept bookings from groups of single people under the age of 25 and all male or all female parties of more than three people. Individual properties may have other restrictions, please see the appropriate property page on our website.
Complaints: All complaints must be notified to the Agent as soon as reasonably practicable, as the Agent may be required to carry out an on-the-spot investigation and if necessary, request the Owner to take remedial action. Should you have a complaint, you must allow the Agent or the Owners the opportunity to put matters right during the Holiday. Guests have a legal obligation to mitigate their loss. If the Agent is denied the opportunity of investigating the complaint within a reasonable time or denied the opportunity to put matters right during the Holiday, then the guest will waive all rights.
Pets: Pets are welcome at specific properties as detailed on the website with the prior consent of Carbis Bay Holidays and the Owners. They must be kept under control, exercised off the premises and not allowed on furniture or in the bedrooms. Under no circumstances should a pet be left unaccompanied within the property as this can result in considerable damage and cause distress to the pet. There is a charge of £35 per pet for up to 1 weeks stay, plus £35 per pet per additional week. If additional cleaning is required, then this will be chargeable and deducted from Guest’s security deposit. Unless outlined on the Website property page, Pets are not permitted in any properties marketed by the Agents or Owners where we state “Regret no pets”. Unfortunately, we are not able to guarantee that pets have not previously been kept in any Property.
Free Broadband / WIFI: All properties providing an internet connection do so as a free service. No guarantee can be made that the service will be compatible with your device. No technical support for the connection is available. Due to the number of parties involved in providing the service we cannot guarantee functionality of the connection although will where possible advise guests of any known problems prior to the stay. Should the broadband connection not be functioning for any reason please let us know so we can try and resolve the fault, no liability is taken by either the Owner or Carbis Bay Holidays.
SKY TV: We are pleased to be able to provide properties with Sky TV, please check the individual properties description for the Sky package provided. Please note that Carbis Bay Holidays are unable to provide the PIN to the Sky box. Therefore, there may be viewing restrictions applied during the day as per Ofcom regulations e.g. Watershed limitations. We apologise for any inconvenience caused.
Website Descriptions: The Agents reserve the right to amend prices quoted, due to errors or omissions. While every endeavour is made to portray a true representation of the website properties, no guarantee can be given to the accuracy of the photographs or descriptions.
Personal property: Any personal effects left by guests can be forwarded to their home address at a cost of £5.00 plus postage (Subject to VAT). Unclaimed articles will be disposed of after 28 days.
The Guest’s Obligations: The Guest has the right to occupy the property for a Holiday only (within the meaning of schedule 1, Paragraph 9 of the Housing Act 1988.) The Guests agree: (a) That in no circumstances should overnight accommodation be provided for guests other than those outlined on the Reservation Form unless Carbis Bay Holidays are notified in advance. (b) To undertake to pay for any losses or damage to the property caused (reasonable wear and tear excepted). (c) To take good care of the property and leave it in a clean and tidy condition at the end of the tenancy. (d) To permit the Owners and Agents reasonable access to the property. (e) That a cot may only be occupied by a child aged 36 months or less. Carbis Bay Holidays are not responsible for the maintenance of cots. (f) Not to cause an annoyance or become a nuisance to occupants of adjoining premises. (g) It is illegal to smoke in properties. In the event of breach of these terms and conditions, the Guests may be required to leave the property during the period of the booking.
Liability: The Agents do not accept liability for any act, neglect or default on the part of the Owners or any other person not within their employ, nor for any accident, damage, loss, injury, expense or inconvenience whether to person or property, which the Guests or anyone connected with the Holiday may incur. We reserve the right to provide alternative accommodations or cancel owing to unforeseen circumstances beyond our control. If for any reason beyond the Owners control, the property is not available on the date booked (owing to fire damage for example) or the property is unsuitable for a Holiday, all Holiday payments and additional charges paid in advance by the Guests will be refunded in full, but the Guests shall have no further claim against the Owners or Agents. The Agents nor Owners are not and shall not be held responsible for any maintenance / building works taking place outside of the rental property.
Disclaimer: All properties are used at your own risk. At properties where there is a balcony or elevated terrace, this is used at your own risk. Parents should ensure that their children are supervised in such areas at all times.
Governing Law & Jurisdiction: The contract is deemed to have been made at Riverside, St Ives Road, Carbis Bay, Cornwall, TR26 2RT; the validity, construction and performance of this Agreement shall be governed by English Law. The Guests submit to the exclusive jurisdiction of the English Courts.
Authority to Sign: The person who sends the reservation form certifies that he or she is authorised to agree the Terms and Conditions on behalf of all persons included on the booking form, including those substituted or included later. He or she agrees to take responsibility for the party occupying the property.
Discrepancies: In case of a discrepancy between these Booking Conditions and any other contents of the Carbis Bay Holidays website, these Conditions shall prevail, but this shall not limit the Agents liability for failure to supply the accommodation as described on the website. In the event that a court finds that a condition in these Booking Conditions is illegal or void, the illegal or void provision will be severed from the remainder of the Booking Conditions, which will continue to be valid and have full force and effect.
